Program Summary

This program provides a practical, real-world approach to advising clients on

prenuptial and postnuptial agreements through an interactive, stimulation based

presentation. Centered around a live client consultation, attendees will observe

how attorneys identify key issues, assess each party’s objectives, and navigate the

legal and practical considerations involved in drafting and negotiating marital

agreements.

Throughout the stimulation, participants will gain a better understanding of the

purpose of prenuptial and postnuptial agreements, common provisions and drafting

practices, and how these agreements can change the way assets would otherwise be

divided under New York’s equitable distribution laws. The program also addresses

situations involving significant differences in wealth between spouses, one sided

agreements and considerations attorneys should keep in mind when advising

clients in these circumstances.

Attendees will leave with a practical framework for approaching prenuptial and

postnuptial consultations, spotting potential issues early and helping clients make

informed decisions while also considering that each client’s needs and objectives

vary

Key topics to be discussed:

  • Understand the purpose of prenuptial and postnuptial agreements and how they differ.
  • Identify the client's goals through effective communication and comprehensive financial disclosure.
  • Compare the default rules under New York equitable distribution law with customized marital agreement terms.
  • Recognize legal risks, including unequal bargaining power, inadequate disclosure, and one-sided provisions that may affect enforceability.
  • Develop practical drafting strategies that promote fairness, clarity, and enforceability.
  • Conclude consultations by summarizing recommendations, outlining next steps, and helping clients avoid common pitfalls.

Testimonials

I simply want to applaud you both for such stellar and entertaining performances in the mock ethics scenarios. The diversity of situations presented was truly eyebrow-raising and memorable. The discussion format was also quite entertaining and digestible. Overall, a great CLE.
Very good course, instructor and materials. I took another course with this instructor and she comes across as very knowledgeable and experienced. She enlivens the course with numerous anecdotes and examples from cases she has handled.
I found the way the material was presented made it interesting but also was effective in modeling how to analyze and discuss these issues with a colleague. This was the most interesting CLE that I’ve ever taken. Kudos to the presenters!
